Terms

Effective · Last updated

These terms cover your use of this website and what sending its contact form does and does not mean. A separate section further down sets out how payment works for each kind of work we do.

Using this site

Lumasyn Digital LLC runs this website, and these terms apply to anyone who uses it. You are welcome to read it, link to it and share its pages.

Do not use the site or its contact form to send spam or anything unlawful, and do not try to break into it, overload it or interfere with how it runs. If you find a security problem, tell us rather than testing it further.

A request, not an agreement

Sending the contact form starts a conversation, nothing more. It does not create an agreement, commit you to buying anything, or commit us to taking on any work.

The work itself

For a launch or a single piece of work, the quote or invoice you agreed to sets out what the job includes. The terms on this page apply to that job as they read on the day you agreed to it.

A signed contract for custom API and portal work keeps its own terms.

Payments, refunds and cancellation

A launch or a single piece of work starts when you approve its quote or invoice by replying to our email, or pay it, whichever comes first. The quote or invoice you approve or pay is the agreement for the job, and the email thread is the record of it.

Only a clear yes sent as a reply to the email that carried the quote or invoice counts as approving it. A text message, or a reply in another email thread, does not.

When a payment is what starts a job, the job starts when the payment counts as made. If that payment is returned or reversed, the job never started.

Agreeing by phone or in person does not start a job.

A launch is paid once, in two halves: the first half to book, and the second half when you approve the finished site.

The first half is the deposit.

The deposit is non-refundable, as it covers work that has already started once the deposit has been made.

We refund the deposit in one case only: an emergency on our side stops the build, and no work is done on it for more than five calendar days.

If we decide such an emergency has happened, we tell you by email.

In every other case the deposit stays non-refundable, including when you cancel, stop replying, or the job ends for reasons on your side.

The full build starts once the deposit has cleared. Until then, we may do small preparation work, and nothing more.

Before anything is published, we show you each new version of the site after we make changes.

The version you tell us you like is the one you approve as the finished site, and the one we publish.

If you do not reply for 30 calendar days after we show you a version, the site counts as never approved.

If you never approve the finished site, we keep the deposit, and you do not owe the second half.

We publish the site only after the second half has been paid.

A launch is complete when the site is published and the second half has been paid.

Once a launch is complete, the second half is not refunded.

Need it sooner? Priority scheduling puts your build first in the queue for a fixed fee — $500 on a standard launch, $750 on full motion — paid with the deposit. We confirm the priority date in writing before you pay, and if we miss it for reasons on our side, the fee is refunded.

The priority fee is not refunded in any other case.

Single pieces of work are paid once — at the listed price, or as quoted in writing before we start.

Fixed-scope work at a listed price, and work beyond a plan, are paid once, on completion, not upfront.

Scoped work is paid once, on completion, not upfront, after we have quoted it in writing.

For fixed-scope work, scoped work and work beyond a plan, the quote is what you approve by replying to our email, or pay, to start the work.

For a Data cleanup sprint, the statement of work is its quote.

For a Data cleanup sprint, we receive no data until you approve its quote by replying to our email, even if you have paid first.

A small change inside work you have already agreed to pay for, such as renaming a page, can be approved by replying to our email.

Your reply approving a small change is your agreement to it, and the email thread is the record of it.

Work beyond what you have agreed to pay for needs a new quote, unless it is small work we fold into work already under way.

Small work we fold into work already under way is not charged. Any added work we charge for gets its own invoice.

When the job is complete, we invoice it, and the invoice terms below apply.

A Market brief is complete when it is ready to hand to you.

Once a single piece of work is complete, nothing paid for it is refunded.

Custom API and portal work is scoped and contracted individually, with defined service levels on both sides.

Custom API and portal work is paid on the payment terms its contract sets, not on the invoice terms below.

Plans run month-to-month with no minimum term. Every plan starts with a launch build, paid once.

Each month of a plan is paid in advance.

Each month of a plan is charged automatically through Stripe, by card or ACH bank transfer only.

If you cancel a plan partway through a month, the unused part of that month is not refunded.

If we end a plan, any refund is at our discretion, decided case by case.

If you end a plan, it stops when the month you have paid for runs out, and we keep the site online for 30 days after that while you move it. The site is yours to take: once any balance is settled, we hand over its code, content and files. Your domain, lead Sheet and Business Profile are yours throughout.

If we change the plan terms on this page, we tell you by email. The change applies to your plan from the first billing month that starts at least 30 calendar days after that email.

For a launch or a single piece of work, you can pay by card or ACH bank transfer through the Stripe link on your invoice, by check made out to Lumasyn Digital LLC, or by Zelle.

A check can be handed to us in person or mailed to the address on your invoice.

Before we send you an invoice, we tell you which of these we offer you and ask which suits you.

Stripe processes card and ACH payments on its own payment page, and we never see your full card number.

A payment counts as made once the money clears: a check once it clears, and an ACH bank transfer once it settles.

A payment that is returned or reversed counts as unpaid.

An invoice for a launch or a single piece of work is due four calendar days after we send it.
